Preamble: presentation of the company

We are pleased to welcome you to the KOS PARIS website, www.kos-paris.fr. (Hereinafter referred to as "the Site").

www.kos-paris.com is a website of the company KOS PARIS, a simplified joint stock company with a capital of €13,004.9, whose head office is located at 102, avenue des Champs-Elysées - 75008 Paris - France, registered with the Paris Trade and Companies Register under number 521 630 319 00 31 and with an intra-community VAT number of FR57521630319 (hereinafter referred to as "KOS PARIS").

We invite you to read carefully the present general terms and conditions of sale (hereinafter referred to as the "GTC") since any person having made a purchase on the Site, hereinafter referred to as "the Customer", automatically implies acceptance of the entirety of the GTC.

 

1. GENERAL PROVISION RELATING TO THE GENERAL TERMS AND CONDITIONS OF SALE

 

• The Customer who buys on the Site declares to have the full legal capacity as well as the legal age (18 years old) to commit himself under the present general conditions of sale.
• All Users of the Site undertake to comply, without restriction or reservation, with these GTC, whether they visit the Site or place an Order. The Customer is required to read them before placing an Order.
• This contract and the GTC governing it are subject to French law.
• KOS PARIS reserves the right to adapt or modify at any time the present GTC. The version of the GTC applicable to any sale is the one appearing online on the www.kos-paris.com website at the time of the Order.

 

2. ORDER

 

To place an order, the Customer, after having filled his virtual basket with the selected products and the desired quantities, then clicks on the "Order" button and provides information on delivery and payment method.

Before clicking on the "Confirm Order" button, the Customer has the opportunity to check the details of his order and its total price and to return to the previous pages to correct any errors or possibly modify his order. Confirmation of the order implies acceptance of the GTC and forms the contract.

The Customer is required to provide complete, up-to-date and fair information, and the Site cannot be held liable in this respect. The Customer is informed that some of the information requested is mandatory for the proper execution of the Order he has placed, which he expressly acknowledges.

Once the Order has been finalised, KOS PARIS will confirm that it has been taken over by sending an email to the Customer at the address indicated at the time of the Order.

KOS PARIS will send the Customer an invoice by email to the address given at the time of the Order. The Customer is advised to keep the invoice.

KOS PARIS undertakes to honour the validated Orders, within the limits of available stocks.

The Order is validated once the payment has been made in full and received by KOS PARIS.

In any event, KOS PARIS cannot be held responsible for any prejudice suffered by the Client, nor can it be held liable for any damages.

KOS PARIS is liable to modify at any time the range of products offered for sale on the Site, without prejudice to the Orders placed by the Customer.

 

 3. PAYMENT

 

• Accepted means of payment 

 Visa, Mastercard, Maestro, American Express and Paypal.

 

• Terms of payment

The payment of the products purchased on the site is made in full at the time of the order. The products remain the property of KOS PARIS until full payment of the order.

 

• Payment security

Payments by credit card on the site are secure and are made via the Payplug payment system. In accordance with current regulations, KOS PARIS does not at any time have access to your bank details. Banking information is encrypted and protected by a TLS protocol to protect the buyer from any fraudulent act. Like KOS PARIS, Payplug does not store your bank details. • Paypal payments

The terms of payment are specific to the Paypal payment platform and are independent of KOS PARIS, which does not intervene in any way in the use of said service. All terms and conditions related to payment via the Paypal payment solution are governed by the General Terms of Use of this service.

 

4. DELIVERY

 

Deliveries are made by Colissimo or TNT depending on the option chosen by the Customer when validating the Order.

 

4.1 Delivery costs

 

The delivery charges applicable to the Order are those mentioned on the Site at the time of the Order in the "Delivery and Returns" section.

 

It is expressly stated that the amount of the delivery charges may vary according to the territory to which the products are delivered, which the Customer expressly acknowledges and accepts.

 

4.2 Delivery time

 

Delivery times are indicated on the Site and depend on the delivery method chosen by the Customer. Delivery times exclude Saturdays, Sundays and public holidays.

 

In application of article L. 216-1 of the Consumer Code, KOS PARIS agrees that the products will be delivered within the time limits specified during the product order process and before the validation of the said order. Delivery times are also reminded in the order confirmation e-mail sent to the customer.

 

As KOS PARIS uses external service providers (carriers, postal services, etc.) for the delivery of the Products, KOS PARIS is totally dependent on these third party service providers. The delivery times indicated on the Site may thus be affected by the service providers without KOS PARIS being responsible for these delays in delivery and the consequences that may result from them.

 

 5. RIGHT OF WITHDRAWAL - RETURN

 

In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the Order to exercise his right of withdrawal from KOS PARIS, without having to give reasons for his decision. This period runs from the day of receipt of the order. In order to exercise this right of withdrawal, the Purchaser must inform KOS PARIS of his/her decision to withdraw by e-mail to [email protected]. Please include: your order number, the product(s) being returned, the reason(s) for the return and a request for an exchange, voucher or refund. In this way, you can be sure that your request will be processed quickly and efficiently.

The product for which the Customer requests an exchange must be intact, unopened and in its original packaging.

It is not necessary to attach any document to the package. We advise you to choose a mode of transport with tracking number. Without a tracking number, we will not accept any claim. If the item is refused by KOS PARIS, it will be returned to the Customer at the expense of KOS PARIS without the Customer being able to demand any compensation whatsoever. If the return has not been announced by the Customer, a voucher is automatically created and sent to the Customer. Orders placed on the KOS PARIS website can neither be returned nor exchanged in points of sale distributing the KOS PARIS brand.

 

6. RESOLUTION

 

KOS PARIS will not be held responsible for damages resulting from the improper use of its products.

In the event of a dispute, you should first contact the company's customer service department by e-mail ([email protected]) to try to resolve the matter informally.

 

7. GIFT

 

You can choose to offer your order of Kos Paris products, the gift wrapping and the personalized card that accompanies your order will be offered to you with no minimum purchase amount. Your order will be elegantly packaged in a box with care paper. To take advantage of this service, simply tick the options in the basket when you validate your order.
